Christy Kiely is a Partner in Seyfarth Shaw’s Labor & Employment department. She has extensive experience advising employers on legal matters related to data analytics, including OFCCP audit defense, pay equity analysis, adverse impact analysis, affirmative action compliance, DE&I analysis, and reduction in force analysis. She has substantial experience conducting sophisticated, proactive equal pay analyses, as well as targeted analyses to respond to compensation claims. Christy represents employers in connection with discrimination, harassment, denial-of-benefits, wrongful discharge, and other claims, and also has significant experience with #MeToo investigations, including sensitive, high-level scenarios. She has litigated under all the major federal employment laws, and advises employers on risk-reducing strategies.

In this session, we’ll talk about how to approach some of the more nuanced promotions issues that arise in audits and give you best practices for analyzing and defending your promotions.  Topics include:

  • Conducting more accurate and insightful adverse impact analyses, including analyses step and sub-pool analyses
  • Integrating promotions analyses with organizational metrics around diversity and inclusion, talent identification, and succession planning
  • Documenting promotion processes, candidate pools and explanations for promotion decisions
